But was brought in for indictment (which the jury declined to do). Duh-uh. It was self-defense. Sheesh! Side note: He was guilty of carrying a concealed weapon. Nothing was said about that charge (I believe it was dropped). * Unfortunately, Daniel Penny was actually indicted for defending others in a similar situation. https://nypost.com/2023/06/28/daniel-penny-pleads-not-guiltyto-manslaughter-charge/ It is sad to think that this may hinge on a single word "chokehold." If he had simply said "submission-hold" the jury may have refused to indict. Technically speaking a "submission-hold" is a type of chokehold meant to subdue rather than kill. But when the lay person (jury) hears "chokehold" they think "airway hold" or "suffocation hold". With that imagery, the jury would clearly think Penny was attempting to kill the man.
