States suing Obamacare

13 states are suing the federal government over the health care plan.

There are three areas in which they are suing. The first one will likely lose, because of the change in interpreting the Constitution over the last century. The other two hold promise.

1. Under the Constitution, Congress does not have the power to institute such a plan.

2. The plan conscripts state governments into carrying out and paying for federal mandates.

3. The individual mandate amounts to an unlawful capitation or direct tax.

On #2, it means unfunded mandates passed on to the states. Medicare and Medicaid rolls will explode, greatly increasing the already burdened state responsibility. "Florida alone estimates that the added costs will grow from $149 billion in 2014 to $938 billion in 2017 to over one trillion dollars by 2019." Can you imagine a state having a $trillion dollar deficit????? This will bankrupt states and end our federalist system, where states carry much of the power of the individual.

On #3, if the Feds can force individuals to buy insurance, will they next force us to buy a car or a home, so as to ensure everyone has at least one? Direct taxes, such as this, are expressly forbidden in the Constitution.

Does this mean the Supreme Court will trash the entire bill? No, they could just knock down key portions of it that are unConstitutional.

All states except Louisiana have Republican attorney generals.

Listening to Rush on the way to work today, he mentioned doing some research and discovering that there were also a lot of lawsuits right after passage of Social Security. One of them even made it to the supreme court. But they were all shot down.

Well, here's hopin'. Here in CO, the att gen filed suit against the Democratic Governor's wishes. Heh!

Yup. One of the nice things about insisting on passing a balanced budget year after year (as Utah does) is that you wind up with a rainy day fund for legal battles against Washington bureaucrats trying to saddle you with ruinous long-term liability.

Hey, don't joke! There are a lot of potentially terrible things happening in 2012. The earth's magnetic fields are expected to reverse. Planets align with center of the galaxy, for instance. The Mayan calendar ends. And Obama gets reelected!

The AG from WA is a Republican, and he did not consult with anyone else in the WA government about signing our state up for the lawsuit. It is a HUGE thing in WA right now that he's done this. He doesn't have the whole state behind him.

Of course, you know that Jefferson was part of the culture of the time period as were many others in both Southern and Northern States. A sad part of history to be sure, but, do we discount his wisdom and the great things he did for our country or should we diminish his standing as a founding father because he owned slaves?

Perhaps the less-appealing traits of some of our founders were more a lingering falsehood of the tyrannical reign of England? Maybe they are actually more reason to avoid tyranny in any of its forms and embrace freedom?

Add Georgia to the list. Our Attorney General refused to file suit (a Democrat in an uphill primary run for Governor), so Governor Perdue is appointing a special council for the duty.

I have mixed feelings about it. The budget in Georgia is already stretched, and while I feel like states and individuals have valid points.. we have a long history in this country of the Federal Government trampling our rights and the rights of states.

Didn't Jefferson free his slaves in his will? or am I thinking of a different founding father?

Washington did. I think Jefferson wanted to, but he died in debt and so his slaves were sold off to pay the debts.

This was an unnecessary slam. Slavery, while a bad thing, was common in his day. You judge them from modern eyes. Meanwhile, many of his day would be ashamed at how we live today.

As it is, Jefferson treated his slaves very well, and sought to reduce/eliminate slavery in the USA. The original draft of the Declaration of Independence, which he wrote, included several lines on how England had introduced slavery to the Americas. Later, he pushed to have slavery illegal in the Northwest Territories.
